1. Market Overview
The Orchard Farmers Market is operated by A&B Market LLC in partnership with The Orchard Town Center. The market prioritizes consistent participation, quality vendors, and a positive customer experience for customers and vendors alike.

The total number of market dates for the 2026 season is seventeen (17), running every Sunday from the beginning of June through the end of September from 9am to 2pm.

2. Application Process
Interested vendors must submit a completed application along with all required documentation. Submission of an application does not guarantee acceptance into the market.

Vendors will be notified of acceptance within approximately three (3) weeks of receipt of a complete application. Incomplete applications may delay approval.
Upon acceptance, vendors must submit the required participation fee in order to confirm and guarantee their space in the market.

3. Vendor Eligibility
Participation is open to:
• Farmers and growers
• Food producers
• Craft vendors (limited availability)
• Nonprofits and commercial vendors such as real estate, windows, chiropractors, etc. (limited availability)

All products are subject to approval by the Market Manager.

Food products must be produced in a commercial kitchen or comply with Colorado Cottage Food laws and labeling requirements. All vendors are responsible for understanding and complying with applicable health and safety regulations.

4. Participation Fees, Commissions & Attendance Policy

Vendor Participation Fee Structure
Vendor participation fees are based on the number of market dates a vendor plans to attend during the season (selected on the application). Vendors must indicate their anticipated level of participation at the time of application.

Participation fees are non-refundable and are based on the participation category selected.

Full-Season Participation (9 or More Market Dates)
Vendors who plan to participate in nine (9) or more market dates during the season are required to pay a one-time $300 participation fee, due upon acceptance.
Full-Season Participation includes:
• Eligibility for attendance-based rebates
• Priority consideration for booth placement
• Priority consideration for returning vendor status in future seasons
• Are subject to the applicable daily market fee structure outlined below

Attendance-Based Rebate (Full-Season Vendors Only)
Full-season vendors may earn back up to $150 of the participation fee based on attendance:
• 0-1 missed market days: Earn a $150 rebate
• 2-3 missed market days: Earn a $75 rebate
• 4 or more missed market days: No rebate

A missed market day is defined as an absence without advance notice, such as 72 hours notice or outlined on the application.

Each full-season vendor is allowed one (1) excused absence per season if notice is provided to the Market Manager at least seventy-two (72) hours in advance. Excused absences do not count toward missed market totals.

This rebate structure is intended to reward consistent participation and replaces daily no-show penalties.

Limited Participation (8 or Fewer Market Dates)
Vendors who plan to participate in eight (8) or fewer market dates during the season are required to pay a one-time $100 participation fee, due upon acceptance.
Limited Participation vendors:
• Are not eligible for attendance-based rebates
• Are scheduled based on availability
• Do not receive priority booth placement or renewal consideration
• Are subject to the applicable daily market fee structure outlined below

Participation Category Adjustment
The Market Manager reserves the right to reclassify a vendor’s participation category if actual attendance differs materially from the level indicated at the time of application.

Daily Market Fees & Commissions
In addition to the participation fee, all vendors are required to remit a daily market fee based on gross sales:
• Full-Season Vendors:
10% of gross sales per market day, with a minimum of $15 per day
• Limited Participation / Drop-In Vendors:
10% of gross sales per market day, with a minimum of $30 per day
• Business or Information Booths (no product sales):
Flat fee of $50 per day

Payment Timing & Method
All daily market fees and commissions must be reported and paid no later than Wednesday following each market date.
Payments must be submitted electronically using:
• The market’s designated online payment processor, or
• Venmo, as directed by the Market Manager

Cash or check payments are not accepted unless expressly approved in advance by the Market Manager.

Failure to submit payment by the stated deadline may result in corrective action, including loss of earned rebates, changes to booth placement priority, probationary vendor status, or removal from future markets.

5. Sales Reporting & Market Integrity
Each vendor is responsible for accurately reporting total gross sales for each market day, including all forms of payment (cash, credit/debit, digital payments, and any other sales methods).

Reported sales totals and applicable market fees must be submitted and paid electronically no later than Wednesday following each market, using the approved payment methods outlined in this agreement.

To ensure fairness and consistency, the market will periodically request reasonable documentation—such as POS summaries, register close-out reports, or daily sales records—to verify reported sales totals. These requests may be made on a random or as-needed basis.

Failure to provide requested documentation, or submission of materially inaccurate sales figures, may result in corrective action, including loss of earned rebates, changes to booth placement priority, probationary vendor status, or removal from future markets.

6. Vendor Priority & Booth Placement
Attendance, timely payment, and compliance with market policies will be used to determine:
• Booth placement priority during the season
• Priority consideration for returning vendors in future seasons

Vendors with strong attendance and compliance will receive earlier booth selection and renewal priority. Vendors with repeated absences, late payments, or compliance issues may be placed on a waitlist or denied future participation.

7. Sales Tax Responsibility
All sales, including food for home consumption and cottage foods, are subject to a 3.85% sales tax.

Vendors are solely responsible for collecting and remitting sales tax directly to the City of Westminster. A&B Market LLC does not collect or remit sales tax on behalf of vendors.

8. Licensing & Insurance
Licensing
All vendors must comply with all applicable city, county, state, and federal regulations governing their business activities and must provide current copies of all required licenses, permits, inspections, and certifications.

Failure to maintain required documentation may result in removal from the market.

Insurance
Food vendors must carry general liability insurance and must list A&B Market LLC as an additional insured on their policy.

9. Space Assignments & Equipment
Each vendor space is approximately 10 feet by 10 feet. Space assignments are determined by the Market Manager. Full-season vendors will be kept in the same location when possible.

Vendors are responsible for providing all tents, tables, chairs, displays, and fixtures.

All tents must be properly weighted with at least 25 pounds per leg.

The Orchard Town Center reserves the right to relocate the market within the property if necessary. Vendor participation agreements remain in effect in such circumstances.

10. Market Operations Rules
Vendors must:
• Arrive no later than 8:30 AM
• Remain set up until market close at 2:00 PM
• Maintain a clean, safe, and attractive booth space
• Remove all trash and leave the space in the same condition as upon arrival
• Treat customers, vendors, and market staff with courtesy and professionalism

Discrimination, harassment, illegal activity, possession of alcohol or controlled substances, smoking, unauthorized distribution of materials, and unauthorized signage are prohibited.

Pets and animals are not permitted in the market, except service animals assisting individuals with disabilities. The sale of live animals is prohibited.

Each vendor booth must be supervised at all times by a responsible individual 16 years of age or older who is knowledgeable about the products being sold.

11. Enforcement & Termination
Violations of market rules or policies may result in verbal or written warnings. Serious or repeated violations, including non-payment or late payment of fees, may result in loss of earned rebates, removal from the market, or denial of future participation. Decisions made by the Market Manager are final.

12. Indemnification
All vendors agree to indemnify, defend, and hold harmless A&B Market LLC, Orchard Farmers Market, and The Orchard Town Center, including their agents, members, and employees, from any claims arising from vendor activities.

A&B Market LLC is not responsible for transactions between buyers and sellers, theft, accidents, or lost or stolen property.

13. Agreement Acknowledgment
By submitting this application and participating in the Orchard Farmers Market, the vendor acknowledges that they have read, understood, and agree to comply with all rules, policies, and procedures outlined in this agreement.
